Go Geothermal Delivery Terms

1. Delivery at place 1.1. Go Geothermal Ltd delivery terms are according to the ICC’s INCOTERMS 2020 DAP clause, Go Geothermal will assume all costs and risk associated with the delivery up to the point of unloading at the agreed upon destination. Once the goods have arrived at the destination the risk passes to the buyer.

1.1.1 Date and place of delivery will be agreed between Go Geothermal and the buyer.

1.2 Go Geothermal will not assume any liability for goods that are damaged in the process of being unloaded or anytime afterwards, supervision must take place by the individual who is accepting the delivery on site at all times.

1.3 If goods need to be shipped abroad, Go Geothermal will be responsible for any cost associated with exporting these goods. However, the buyer will be required to pay any cost that is incurred through importing the goods.

2. Unavailability for collection

2.1 If at the time of drop off there is no person available to collect the delivery, the driver may leave your goods in a safe space if one has been provided by you in advance.

2.1.2 The buyer accepts all responsibility for any goods that are damaged whilst being unloaded into the safe space.

2.1.3 Go Geothermal will not assume any liability for any stolen or damaged goods that have been left in a safe space that was specified by the buyer.

2.2 If no suitable safe space has been provided by the buyer and the delivery is unable to be fulfilled, Go Geothermal will store the goods until another delivery is organised. The buyer will be responsible for all costs and expenses related to the re-delivering of the goods.

2.3 A safe space is a suitable location that you believe to be both secure and weatherproof which is available to hold your goods. This safe space must be easily accessible to the driver.

2.4 A safe space may be deemed unsuitable for any reason including but not limited to:

  • -Safe space could not securely fit all delivered goods;
  • -Driver deemed leaving goods in safe space may have resulted in damage or theft;
  • -Safe space could not be accessed by driver;
  • -Any other unforeseen reason.

3. Delayed Delivery

3.1 If the delivery is delayed, Go Geothermal will not be liable for any cost or expense that may be incurred due to the delay in delivery.

3.2 If the delivery is delayed by 5 days, the buyer retains the right to cancel the purchase.

3.2.1 The buyer is not entitled to cancel the purchase if the delay is:

  • The fault of the buyer;
  • Due to a force majure event.

4. Item Substitution

4.1 Go Geothermal retain the right to replace or modify the goods in any manner provided the replacement or modified product operates in substantially the same way.

4.2 We may substitute an item in your delivery for any reason, including:

  • Running out of stock of the original item;
  • No longer selling the original item; or
  • Any other business-related reason.

5. Damaged Goods or Missing Goods

5.1 Upon collection of delivery, the buyer holds the responsibility to check the goods for any damaged or missing items. The driver will wait whilst you carry out all suitable checks to these goods.

5.1.1 In the case that there is any damage, the delivery must be signed for as “DAMAGED” or “MISSING”. If the delivery is not signed for as “DAMAGED” or “MISSING” then a claim cannot be made retrospectively.

5.1.2 If another person is collecting goods on the buyer’s behalf, they will be responsible for checking the goods for any damaged or missing items.

5.2 If the goods are left in a safe space, the buyer will have 24 hours after delivery to report any damage. If after 24 hours no damage has been reported, the delivery will be deemed successful, and no claim can be made in the future for any damage to these goods.

5.3 All purported damaged goods must be sent back to Go Geothermal for inspection. We will organise the collection of these goods.

5.3.1 If it is deemed that the goods were damaged prior to them being unloaded, Go Geothermal will organise the delivery for any replacement goods being delivered or credit the buyer a full refund for all the damaged goods.

5.4 If it is found that the damage to the goods occurred during unloading or anytime afterwards, without supervision on site, we hold no obligation to replace any of the items or credit a refund to the buyer.

5.5 All returned goods will be subject to inspection, if we decide the purported damaged product(s) can not be classed as reasonably damaged, we will still send replacement goods to you.

5.5.1 However, you will bare all the cost and risk of the delivery for all replacement goods sent to you.

5.5.2 You may also be subject to a restocking fee of up to 30% of the price of the purported damaged goods we receive by you.

5.6 In the case that we decide any goods sent back to us by the buyer are not reasonably damaged and the buyer wishes to take ownership of the goods again, we will organise a delivery for the goods to be returned to you. The buyer will bare all cost and risk associated with the redelivery of these goods.

6. Returning Items

6.1 If the buyer wishes to return an item for any reason other than it being faulty or damaged, they must give Go Geothermal notice so that a restocking form can be provided to the buyer.

6.1.1 The restocking form must be completed in full and sent to Go Geothermal via email for approval prior to the goods being returned to us.

6.1.2 A copy of the completed restocking form must also be returned with the goods.

6.2 All returned items may be subject to a restocking fee up to 30% of the original price of the returned item(s).

6.3 All returned items must be in the condition in which you received them, such as in a sealed bag or in their original packaging.

6.3.1 If the returned item(s) is/are not in the same condition in which it was sent to you, Go Geothermal may refuse any refund for the returned item(s).

6.4 We do not accept returns for:

  • Bespoke goods bought in especially for a project:
  • Cut pre insulated pipes;
  • Grout; or
  • Rauvitherm PU foam.

6.5 Go Geothermal hold absolute discretion for accepting returns of the following items:

  • Collector pipe;
  • Probes; and
  • Fluids.

6.6 The buyer will bare all cost and risk associated with the delivery of goods when returning the goods back to Go Geothermal.

7. Force Majure

7.1 We reserve the right to suspend or terminate all deliveries if we are unable to comply with our contractual duties due to events beyond our control. This includes but is not limited to:

  • Extreme weather conditions such as storms, tornados, floods or earthquakes;
  • Pandemics or epidemics;
  • Acts of God;
  • Any law, measure or action taken by a relevant government or public authority;
  • Strikes;
  • Fires resulting in loss of stock or workforce;
  • Non-performance by suppliers.

8. Our delivery terms shall be exclusively applicable; terms to the contrary or terms deviating from our terms will not be recognised by us unless we have expressly agreed to their validity in written format.
